Terms and conditions by participating my yoga- and dance classes and workshops:
1. During the yoga- and dance classes and workshops, that I choose to participate in, held by Sophie Povel, I voluntarily and willingly choose to participate in the classes offered by Sophie Povel, including but not limited to Meditation, Pranayama, Asana, Alignment, Chanting, Philosophy, Hands-on adjustments, Teaching Skills, dancing, any other yoga/dance related class, exercise or event (including social or spiritual events), and any other related yoga activity offered by Sophie Povel (all such classes are hereto referred to as “Yoga-/dance Classes”). I recognize that the Event and the Yoga/Dance Classes in which I will be participating may require physical and mental exertion. I further understand and acknowledge that despite the great amount of care that Sophie Povel is taking, the Event and the Yoga/Dance Classes may expose me to many risks including accidents, high blood pressure, physical injury, fainting and may aggravate pre-existing injuries. I understand that I could experience muscle, back, neck, and other injuries as a result of my participation in the Yoga/Dance Classes. I assume all risk of injuries associated with my participation in the Yoga/Dance Classes, including but not limited to injuries, strains, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me. In further consideration of being permitted to participate in the Event, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the Classes and wokshops, including those which may result from the negligence of the Sophie Povel. I understand that it is my full responsibility to consult a physician/doctor prior to and regarding my participation in the Yoga/Dance Classes. I represent and warrant that I am physically fit and I have no medical condition which would prevent my full participation in the Yoga/Dance Classes I have applied to join. I understand that in the event of any injury, in need to consult a doctor, or in need of hospitalization, I shall be responsible for my own treatment and for any fees or amounts related to such consultation or hospitalization. If I am pregnant I understand that I participate fully at my own risk and that of my unborn child/children. Also, if I have any injury or problem whatsoever (including but not limited to injuries, heart problems, back or neck problems, asthma, epilepsy, ulcer, hernia, high blood pressure, and so forth), I understand that I may be not fit to participate in certain Yoga/Dance Classes, in which case I will inform Sophie Povel immediately of such condition, and Sophie Povel shall have the full authority to prohibit me from participating in such Yoga/Dance Classes, if need be. In any case, whether I have disclosed or have not disclosed such injury or problem, I understand that if despite my injury or problem I still decide to participate in the Yoga/Dance Classes, I would be participating fully at my own risk. I understand that from time to time during Yoga/Dance Classes, the instructor may physically adjust students’ form and posture, and I hereby accept receiving such adjustments. If I do not want such physical adjustments for any reason whatsoever, notably because of an injury, I will so inform the instructor at each class I attend. I also acknowledge that if I do wish to receive such adjustments, it is my responsibility to inform the instructor when an adjustment has gone as far as I desire at that time.I hereby take full and sole responsibility from any liability of loss or damage to personal property associated with the Event held by Sophie Povel. I further understand and agree that once I have joined any of the Yoga/Dance Classes, I shall be responsible and liable to pay Sophie Povel the fees of the Course/class/workshop. I am participating in, fees which are strictly non-refundable. I understand and agree that if the Event needs to be canceled due to multiple Corona Virus infection, I will have two options: To finish the yoga/dance. I understand and agree that Sophie Povel may from time to time, as it deems fit, change the course content, schedule, teachers, and any other academic, methodological, technical, or logistic aspect of the Event I am participating in. I acknowledge that Sophie Povel may from time to time photograph, video or otherwise record classes of the Event that may include me, and place such photographs and videos on its website or social media platform. I hereby consent to the use of my image that may appear in such photographs or video. After having read this waiver and knowing these facts, and in consideration of my participation in the Event, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE, RELEASE, AND COVENANT NOT TO SUE Sophie Povel from any responsibility, liabilities, demands, actions, or claims of any nature whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in the Event and in Sophie Povel's activities, or while in, on or upon the premises where the activity is being conducted.

Code of conduct The student is required to maintain basic rules of conduct, especially: behave respectfully, legally, safely, and ethically towards trainers, fellow students at all times. The student will be held responsible for any intentional damage including financial consequences. In case of Misconduct: Sophie Povel reserve the right to terminate an applicant’s stay, should the applicant severely and/or repeatedly break the herewith signed terms and conditions and/or the house rules. In such cases, Sophie Povel provide no refund for the course/class fee.

Vanuit mijn werkzaamheden richt ik een groep op voor het bieden van steun aan vrouwen en meisjes die slachtoffer zijn geworden van grensoverschrijdend gedrag, zowel op het werk, op school als elders. We streven ernaar om discriminatie op de werkvloer te bestrijden en een veilige omgeving te creëren voor alle individuen, ongeacht geslacht, afkomst of leeftijd.
Dit initiatief is geboren omdat ik vanuit mijn werkzaamheden streef naar een veilige omgeving voor iedereen en uit de noodzaak om actie te ondernemen tegen grensoverschrijdend gedrag in de muziekbranche en daarbuiten. We zijn toegewijd aan het ondersteunen van slachtoffers, het vergroten van bewustzijn en het bevorderen van verandering.

Through my work, I am establishing a group to provide support to women and girls who have become victims of boundary-violating behavior, both in the workplace, at school, and elsewhere. We aim to combat workplace discrimination and create a safe environment for all individuals, regardless of gender, background, or age.
This initiative has emerged from my commitment to fostering a safe environment for everyone in my professional endeavors, and from the necessity to take action against boundary-violating behavior in the music industry and beyond. We are dedicated to supporting victims, raising awareness, and promoting change.

1. GENERAL
1.1 Povelart Vlieland is a website operated by Povelart, located at Vlieland, The Netherlands. You can visit us at www.povelart.com.
1.2 These Terms and Conditions apply when you, as a Customer (hereinafter referred to as “Customer” or “you”), place an order via www.povelart.com and related pages (the “Website”). By using this site, you also confirm that you have read and approved our Privacy Policy.
1.3 To make purchases on our website, the Customer must, according to Dutch law, be at least 18 years old.
1.4 Povelart Vlieland reserves the right for any image or writing errors on the page, such as errors in descriptions, technical specifications, prices, and price adjustments. If an incorrect price is found on an ordered item, Povelart Vlieland will inform the Customer and await approval of the corrected price before proceeding with the order.
1.5 The Website and all its content are owned by Povelart Vlieland or its licensors. This means that nothing on the Website may be copied or used without the prior written consent of Povelart Vlieland.
1.6 If the Customer has created an account on Povelart Vlieland, the Customer is responsible for ensuring that no one, except the Customer, uses the Customer’s login details. The Customer must ensure that any documentation containing login information is stored securely. If there is any suspicion that someone unauthorized has obtained access to the login credentials, the Customer must notify Povelart Vlieland immediately. The Customer is responsible for all purchases made using their login credentials unless notified otherwise.
2. ORDERS
2.1 Once the Customer places an order on the Website, a purchase agreement is entered into between the Customer and Povelart Vlieland. The Customer is advised to save the order confirmation for any future contact with customer service. The order confirmation also serves as proof of purchase.
2.2 The Customer is responsible for ensuring the accuracy of the information provided, including name, email, and address.
2.3 Orders can be canceled before being confirmed by Povelart Vlieland. After confirmation, if the Customer wishes to cancel the order, they must email support@povelart.com as soon as possible. If the order has already been dispatched, it will be processed as a return (see Section 5).
3. PRICES AND PAYMENT
3.1 Prices on the Website apply to orders placed on the Website. All prices include VAT for delivery within the EU. Prices outside the EU may be subject to different regulations.
3.2 The Customer is responsible for any customs duties or import taxes levied by the destination country.
3.3 The Customer can view prices and pay in various currencies, including EUR, USD, and GBP.
3.4 All payments are encrypted and processed according to the highest security standards. The Customer can pay via Debit or Credit Card (Visa, Mastercard, American Express) or alternative methods such as Klarna (Pay Now, Pay Later, and Slice It options).
3.5 Povelart Vlieland reserves the right to charge the Customer once the order is confirmed, unless an invoicing method via Klarna is selected.
4. SHIPPING AND DELIVERY
4.1 Orders typically leave Povelart Vlieland's warehouse within 3-5 working days, unless stated otherwise in the order confirmation. Delivery time depends on the destination country.
4.2 Delivery will occur within 30 working days after Povelart Vlieland confirms the order.
4.3 If the order is delayed beyond 30 days, the Customer may cancel the order.
4.4 Some packages may be delivered directly to the Customer’s mailbox, but typically, the Customer will receive a notification to pick up the package from a designated point.
4.5 If the package is not picked up, Povelart Vlieland reserves the right to charge a fee for freight and administrative costs.
4.6 Orders containing products from different categories may be shipped separately.
4.7 Povelart Vlieland is responsible for any damages incurred during shipment. If damage is found upon delivery, the Customer should contact the shipping company and notify customer service with pictures.
5. RETURNS, WITHDRAWAL & EXCHANGE
5.1 The Customer has a 14-day withdrawal period after receiving the product(s). The Customer may cancel the purchase within this period by notifying Povelart Vlieland.
5.2 The Customer is responsible for the condition of the product during return shipping. The product must be returned in its original condition and packaging. The Customer should contact customer service before returning any items.
5.3 The Customer is responsible for shipping costs and transport risk for returns. The return must be traceable, and proof of shipment should be retained.
5.4 Once the return is processed, Povelart Vlieland will issue a refund using the original payment method.
5.5 Exchanges are handled as returns, and the Customer will need to place a new order.
5.6 Custom or special orders cannot be returned or exchanged.
6. WARRANTY AND COMPLAINTS
6.1 Complaints regarding defective products must be reported within a reasonable time. If a complaint is made within two months, it is considered on time.
6.2 Defective products will be assessed according to applicable consumer protection laws. Complaints should be emailed to support@povelart.com.
7. GIFT CARDS
7.1 Gift cards are valid for two years from the issue date and can be redeemed at Povelart Vlieland’s webshop. They cannot be exchanged for cash or refunded.
8. FORCE MAJEURE
Povelart Vlieland shall not be liable for delays or damages caused by circumstances beyond our control, such as extreme weather, fire, flood, strikes, or government actions. If such conditions persist for over six weeks, both the Customer and Povelart Vlieland have the right to cancel the purchase.
